T&Cs for BSG Terminals
Overview
The Pit Stop Gift Card activation application (“site”) is operated by Pit Stop (ABN 82 145 328 703). Throughout the site, the terms “we”, “us” and “our” refer to the eGift it Business & Pit Stop Recharge website or Pit Stop Recharge Pty Ltd (PSR).
Pit Stop Gift Card Activation web app is a website that allows businesses (“customers”) to purchase digital gift cards (“Gift Cards”) to be sent electronically to chosen recipients’ mobile phone numbers and email addresses.
By using our Service, you agree to be bound by the following terms and conditions (“Terms & Conditions”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. When creating a user account on our site, you will be prompted to accept these Terms before gaining access to our Service.
Please read these Terms & Conditions carefully before accessing or using our Service. By accessing or using any part of the site, you agree to be bound by these Terms & Conditions. If you do not agree to all the terms and conditions of this agreement, then you may not access our Service. If these Terms & Conditions are considered an offer, acceptance is expressly limited to these Terms & Conditions.
Any new features or tools which are added to the current site shall also be subject to the Terms & Conditions. You can review the most current version of the Terms & Conditions at any time on this page. We reserve the right to update, change or replace any part of these Terms & Conditions by posting updates and/or changes to our site, including but not limited to, updating the “Last Updated” date. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
By agreeing to these Terms & Conditions, you confirm that you are an authorised representative of your business and at least the age of majority in your state of residence.
General Conditions
We reserve the right to refuse service to anyone for any reason at any time. We also reserve the right to terminate accounts for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us.
Authorised Business Representative
By creating an account and clicking the check box which states “I am an authorised representative of this company and accept the Business Terms & Conditions and Privacy Policy”, you agree to accept full responsibility and liability for any purchases made using your account. This includes, but is not limited to, purchases made using any credit card (whether or not you are the owner/cardholder), loyalty and purchases made authorised credit. If purchases are made using a credit card that is found to be fraudulent or stolen, the Business account holder accepts full liability. We do not accept any liability for purchases made using unauthorised credit cards and will not compensate the account holder if a credit card is found to be fraudulently used.
Account holders will not gain access to the Services until approval has been explicitly granted by Pit Stop Recharge.
Gift Cards
Gift Cards that you purchase through our site are issued by participating third-party retailers (“Retailers”). Gift Cards can only be used/redeemed in Australia. Customers should check with Retailers before purchasing a Gift Card if unsure of where or how they can redeem.
We reserve the right to add or remove Gift Cards from the Web App at any time, without advance notice. All prices are subject to change without notice. The minimum and maximum denominations able to be loaded onto a Gift Card is determined by both Pit Stop Recharge and each individual retailer.
The expiry period of a Gift Card will be displayed both in the product description at the time of purchase as well on the recipient’s page displaying the Gift Card information. This date is determined by the Retailer. Please refer to this expiry date to ensure you redeem your Gift Card in the allocated time frame. PSR is not responsible for users not redeeming their Gift Cards before the expiry date has passed. All gift cards sold in NSW have a minimum 3 years’ expiry.
Unless otherwise stated by the applicable Retailer, the Gift Card is not redeemable for cash. Treat your Gift Card like cash. PSR is not responsible if a Gift Card is lost, stolen, destroyed or used without permission. PSR is not responsible if any Gift Card is not accepted at a Retailer through no fault of ours.
Retailers
The issuing Retailer of each Gift Card has their own terms and conditions which must be adhered to and accepted, in addition to these Terms. Please review the Retailer’s terms and conditions before purchasing a Gift Card and contact the Retailer if you have any questions or issues. PSR is not responsible for the Gift Card program of the Retailers.
PSR does not need to be part of any dispute resolution between you and the Retailer. We will do our best to assist on all occasions but cannot be held responsible for the Gift Card policies of Retailers. PSR is not responsible for the refund of purchase price or return of any products purchased from Retailers, whether a Gift Card has been used or not. We have no obligation to resolve any dispute between you and any Retailer. PSR endeavours to work with reputable Retailers, however PSR holds no liability for the sale of products or services provided to you by a Retailer. PSR is released from any liabilities arising from or relating to the Retailer once a Gift Card is purchased.
Personalisation Options
We offer the ability for customers to personalise their Gift Card by adding digital wrapping paper, digital greeting cards and messages, music and animations (collectively, “Add-Ons”). We reserve the right to change the price at any time for these Add-Ons, without notice. We reserve the right to add or remove the availability of specific Add-Ons at any time, without notice. Add-ons are in digital format only when purchasing a Gift Card.
Payment Options
Accepted forms of payment will be displayed at checkout and include Australian credit cards (VISA & Mastercard only) and direct bank transfer. We reserve the right to add new forms of payment at any time. Credit card transactions will be fully billed at the time the order is completed and approved. If an order is paid for using bank transfer, the order will not be completed or processed until payment has fully cleared into our bank account. As soon as we have received full payment, the order will be processed.
If you choose to schedule the delivery of a Gift Card at a date in the future, you will still be billed on the date of the completed transaction, not on the delivery date.
Gift Card Activation and Delivery
A Gift Card will be activated when the transaction has been completed and payment received. The expiry date of the Gift Card will be calculated based on the activation date, not the scheduled delivery date.
If the present day’s date is selected for a Gift Card to be sent, the delivery via mobile phone and email will take place as soon payment is received.
If a future date is selected for a Gift Card to be sent, the delivery via mobile phone and email will take place at 9am (AEST) on that chosen date, subject to the approval of the order and receipt of payment. If payment is received after 9am (AEST) on or after the selected date, the Gift Card will be delivered as soon as possible once payment is received.
As the Gift Card is activated as soon as the order is approved, and not on the scheduled date of delivery, the purchaser must consider the reduced time available for the recipient to redeem the Gift Card if a date in the future is selected.
It is your responsibility as the customer to ensure all recipient details are accurate, including name, email address and mobile phone number. You have the ability to edit details and re-send Gift Cards via email in the event of an unsuccessful delivery. Gift Cards cannot be cancelled if you have entered an incorrect email address or phone number.
Cancellations, Exchanges & Refunds
All purchases made are final. Please choose carefully as we do not offer cancellations, exchanges or refunds on Gift Cards. A re-issue or replacement of a Gift Card is not available unless it is deemed to be the fault of PSR, or where otherwise required by law.
If you have any issues at all with your order or Gift Card, please contact us and provide as much detail as possible, including order number, date of transaction, and in-depth details of the issue/s. Our customer service team is happy to assist wherever possible.
PSR is not responsible for the refund or return of any products purchased from Retailers using the Gift Card.
Accuracy, Completeness and Timeliness of Information
We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.
This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site.
Modifications to the Services and Prices
Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service. We reserve the right to end discounts or promotions before the original time or date stipulated in communications, without notice.
Order Refusals or Restrictions
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per order. These restrictions may include orders placed by or under the same business account, the same credit card, and/or orders that use the same billing and/or shipping address.
Accuracy of Billing and Account Information
You agree to provide current, complete and accurate business information when creating an account for approval. You agree to promptly update your account and other information, including your email address and phone number, so that we can complete your transactions and contact you as needed. You agree to contact us immediately if your business name or ABN changes, so we can accurately invoice you and complete your transactions.
Security
We discourage account holders to share their password or login details of the Web App. We encourage users to log out as soon as they have finished using the Site so that no unauthorised access can be gained to your account.
We encourage account administrators to add new users to the account so that all activity can be tracked to specific individuals. Administrators have the ability to limit access to specific users of the same business.
The Web App is a secure site with a current SSL Certificate. More information can be found by clicking the lock icon in the URL bar. PSR does not hold or have access to any customer’s financial information. We use a third-party payment processor that is compliant with the Payment Card Industry Data Security Standard (PCI DSS).
3DS Security
PSR takes security for customers and the community very seriously. We have implemented Strong Customer Authentication in the form of 3D Secure (3DS) where applicable. By implementing 3DS, you as a customer may be asked to enter a second authentication by your financial organisation to verify your identity. This process can take a couple of seconds but ensures that only the correct person is using your credit or debit card. This process of authentication is directly between you and your bank. We are proud to be implementing socially responsible security practices and thank you for taking the extra couple of seconds to check out.

Certain content, products and services available via our site may include materials from third-parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.
User Comments, Feedback and Other Submissions
If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, through our official social media channels, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.
You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libellous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.
Prohibited Uses
In addition to other prohibitions as set forth in the Terms & Conditions, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable. You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service is provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall PSR, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
Intellectual Property & Trademarks
Unless otherwise indicated, the Australian intellectual property legislation protects all Services, content and other materials of PSR and e-gift it Pty Ltd.
“e-gift it” is a registered trademark. “eGift it Business”, “eGift it”, the logo and any other eGift it Business product or service names are our intellectual property and may not be copied, imitated or used, whether in whole or part, without the prior written consent of e-gift it Pty Ltd. All other trademarks and names mentioned in the Service are the property of their respective owners and cannot be used without the permission of the relevant holder.
Indemnification
You agree to indemnify, defend and hold harmless PSR, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms & Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
Severability
In the event that any provision of these Terms & Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms & Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.
Applicable Law
PSR is an Australian company, based in New South Wales, Australia, and our Service is subject to the laws of New South Wales and Australia. Gift Cards purchased on our site are only valid in Australia. You are responsible for compliance with applicable laws if you access the Service outside of Australia.
Termination
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms & Conditions are effective unless and until terminated by either you or us. You may terminate these Terms & Conditions at any time by notifying us that you no longer wish to use our Service, or when you cease using our site.
Entire Agreement
The failure of us to exercise or enforce any right or provision of these Terms & Conditions shall not constitute a waiver of such right or provision. These Terms & Conditions and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms & Conditions).
